Understand the Level of Your Court Martial

There are three levels of courts-martial: general, special and summary.

Summary Court Martial
The lowest level of court martial is summary, which is used in minor offenses. Commanders can send a case to court-martial. The penalties imposed by a summary court-martial can be:

  • Confinement for a month or less
  • Hard labor without confinement for 45 days or less
  • Restriction for two months or less
  • Forfeiture of 2 / 3 of your pay for a month or less
  • Reduction of enlisted grade

Special Court Martial
A special court-martial is for misdemeanor crimes. The penalties imposed cannot include death, dishonorable discharge or dismissal. A penalty of pay forfeiture of two-thirds of your pay cannot exceed one year in duration, and you cannot be confined for more than one year.

General Court Martial
A general court-martial is for felony criminal offenses. There are heavy penalties that can be imposed upon you if you are convicted. This is the court martial you will face if you are accused of any of the following offenses:

  • Murder
  • Sexual assault
  • Aggravated assault
  • Drug trafficking / distribution
  • Arson
  • Crimes related to child pornography
  • Some high-value theft crimes
