Physical Evaluation Boards
The military attorneys of McCormack & Associates represent
servicemembers at Physical Evaluation Boards (PEB) for all branches
of services.
The process begins with a servicemember being referred to a Medical
Evaluation Board (MEB). The MEB determines whether a medical condition
interferes significantly with the member’s ability to carry
out the duties of his rank and rate. If the MEB determines that
there is a significant interference with a servicemember’s
ability to perform his duties then the case is referred to an informal
PEB. The informal PEB will determine if the servicemember is fit
or unfit for duty. If it is determined that a servicemember is unfit
for duty then the informal PEB can recommend discharge with severance
pay or a disability retirement. The informal PEB will also assign
a disability percentage.
A servicemember who is dissatisfied with the determination that
he is unfit for service or who believes that the disability percentage
assigned is not high enough may appeal to the formal PEB. The formal
PEB will conduct a hearing where additional medical evidence and
witnesses will be called to testify. The formal PEB will make a
determination of fitness for duty and disability level based upon
the hearing.
The attorneys of McCormack & Associates have experience in
reviewing, preparing and presenting cases before the PEB. We will
become involved early in the PEB process and determine whether additional
documentation is needed, what witnesses should be called and we
will prepare those witnesses for the formal hearing.
